Maharani watch and win contest rules and regulations

"Maharani Watch and Win Contest" ("Contest") with regard to the program "Maharani" ("Program") to be produced and telecasted by Vijay ("Channel") as stated hereunder:

1. The Contest shall remain open from One (01) Week from October 19, 2009 at 1900 hours to October 23, 2009 at 1900 hours ("Period").

2. The Contest shall be open to the jurisdiction of Tamil Nadu only.

3. The Channel will telecast on air promos during the Period which will state the mechanism (manner) in which the viewers can participate in the Contest.

4. A viewer(s) shall be asked questions during the show in the mentioned period and the viewer(s) desirous of participating in the Contest ("Participant(s)") can participate via SMS to 57827 through mobile. The subscribers of Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice, Aircel, Reliance Telecom, Tata Indicom, BSNL and MTNL Mumbai may participate in the Contest.

5. The cost charged to the Participant(s) by the respective network provider(s) shall be as follows:

a) Rs. 3 per SMS for Vodafone, Airtel, BPL, Idea, Reliance Communications, Spice, Aircel, Reliance Telecom, Tata Indicom subscribers
b) Rs. 2 per SMS for BSNL subscribers
c) Rs. 1 per SMS for MTNL Mumbai subscribers

6. There will be different question on every day of the show based on the show telecasted for that particular day. The contest shall be applicable only for Original telecast and not for the repeat telecast of the program.

7. The Viewers have to send the reply every day for the particular question asked in an episode. The Viewers have to send the SMS before 1950 hours on the particular day of the telecast. Any SMS received by VTPL after 1950 hours shall not be taken into consideration.

8. The cost of each call shall be charged by the respective network operators. Neither Vijay Television Private Limited ("VTPL") nor the Channel shall be responsible in case of any delay in delivery of SMS / network problem and/or the costs charged by the mobile operators. Any dispute in connection to the same should be settled directly between the subscriber and the mobile operator without involving VTPL and/or the Channel.

9. VTPL and/or the Channel reserve the right to disqualify any Participant(s) from participating further in the Contest without assigning any reason. The decision of VTPL and/or the Channel in this regard shall be final and binding upon the Participant(s).

10. VTPL and/or the Channel shall select the winner after the end of the period of the contest. There cannot be any joint winner. Every winner has to be individual.

11. The total worth of the prize money for the contest shall be Rs.1,00,000/- (Rupees One Lakh Only). The prize money shall be distributed amongst the winners selected during the contest period. Every individual Winner as stated point no. 9 shall be entitled for the maximum prize money of gold worth Rs.4999/- (Rupees Four Thousand Nine Hundred and Ninety Nine Only).

12. VTPL and/or the Channel reserves the rights to decide the Winner(s) of the Contest.

13. VTPL and/or the Channel shall contact/inform the Winner(s) at the mobile number through which the viewers send the SMS.

14. The decision of VTPL and/or the Channel shall be final and binding on all the Participant(s) and by participating in the Contest, it shall be construed that the Participant(s) has waived his/her right to raise any dispute against any decision made by VTPL and/or the Channel with regard to the selection of the Winners and/or the Prize and/or for any other reason whatsoever.

General Rules

1. The Participant(s) should be citizens of India, residing in India and above 18 years of age to qualify for the Contest.

2. The Participant(s) should not have criminal conviction or an arrangement or a contract that prevents the Participant(s) from participating in the Contest.

3. The Participant(s) in whose name the number (from which the call is made) is registered with a network operator shall be construed to have participated in the Contest. Consequently, the Winner in whose name the number is registered with a network operator shall be entitled to the Prize at the discretion of VTPL.

4. The Winners must submit with VTPL and/or the Channel a copy of the last two bills issued by the network operator as a proof that the number is registered in the name of the Winner and such other documents that could be furnished as proof that the mobile number is registered in the Winner's name.

5. Proof of age is a must for the Participant(s) and must be submitted to the Channel/ VTPL (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

6. VTPL and/or the Channel reserve all rights to make amendments to the existing rules without prior notice or withdraw the Contest without giving prior notice in connection thereto. The viewers/Participant(s) shall be solely responsible to check the rules and regulations of this Contest on the website from time to time.

7. Non-conformance by any Participant(s) and/or the Winners of the rules of the Contest will disqualify them from participation or winnings, immediately, as the case may be.

8. The Participant(s) and/or the Winners of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or VTPL and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Participant(s) and/or the Winner. Further, the Participant(s) and/or the Winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Participant(s) and/or the Winners agree that the footage of any nature with regard to the Participant(s) and/or the Winners shall vest with VTPL, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

9. The Prize will be delivered to the Winner(s) within ninety (90) days from the date of declaring the Winner(s). The Winner(s) cannot exchange the Prize for another item of any nature or cash equivalent. VTPL and/or the Channel shall not be responsible and/or liable for any delay, damage, loss, and theft etc., caused to the Prize in transit. If the Winner(s) refuses to accept the Prize awarded, the Channel and/or VTPL shall be released from all obligations towards the Winner in connection to the Prize won by the Winner. Further, after forfeiting the Prize, VTPL and/or the Channel shall be entitled to randomly select and declare another Winner(s), as it deems fit and at it own discretion, and award the Prize, to that winner.

10. By participating in the Contest, it shall be deemed to be construed that the Participant(s)/Winner(s) has waived his/her right to raise a dispute in connection to the Prize so awarded to the Participant(s) upon winning the Contest.

11. By participating in the Contest, it shall be construed that the Participant(s) and/or the Winner has agreed that the Participant(s) and/or the Winner shall hold harmless the Channel, VTPL, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by the Participant(s) and/or the Winners, in any manner, whatsoever in connection with the Contest and/or the Prize and that the Participant(s) and/or the Winners has waived all rights to file in person or through any family member or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or VTPL to claim any damages or reliefs or otherwise.

12. The Winner agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or VTPL, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, the Channel and/or VTPL cannot be held responsible for the same.

13. The Channel and/or VTPL is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Winners in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Prize.

14. Employees of the Channel or VTPL, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to enter the Contest.

15. The Participant(s)/Winners agree to all the decision(s) made by VTPL and/or the Channel that all the decision shall be final and binding upon them.

16. VTPL and/or the Channel reserve the right to forfeit the Prize in the event it is found by VTPL and/or the Channel that any information provided by the Winner(s) is wrong or any misrepresentation made by the Winner(s) is false. VTPL or the Channel shall have the right to declare another Participant(s) as the winner of the Contest and transfer the Prize to that person.

17. Any and all taxes and/or levies applicable under the laws of India shall be borne by the Winner(s) in relation to the Prize.

18. In the event, the Winner(s) is/are required to pay withholding tax and/or tax deductible at source under the Income Tax Act, 1961 under the laws of India in relation to the Prize, the Winner(s) shall furnish a copy of the receipt (challan) in relation to the withholding tax and/or tax deductible at source paid by the Winner(s).

19. All Participant(s) and the Winner, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or VTPL in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to VTPL and/or the Channel herein.

20. The participation of the Participant(s) in the Contest shall mean that the Participant(s) has read, understood, accepted and agrees to abide with all the rules including the General Rules of the Contest.

21. All the copyrights of the program and any activities with regard to the program shall belong to VTPL and that the Winner shall not have any rights even where there is involvement of Winner.

22. The Participant(s) and the Winner shall comply with the laws of India.

23. The Contest shall be governed by the laws of India.

24. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by VTPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Chennai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Participant(s) who has raised the dispute.

25. Subject to the provision of Clause 23 above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief's under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Chennai, India.
